Protecting Your Assets for the Next Generation

What asset protection means

Asset protection planning is the use of lawful structures, such as Wills, trusts, property ownership changes and business agreements, to reduce the risk of wealth being lost to avoidable claims. The main threats families face are sideways disinheritance after remarriage, a beneficiary's divorce or bankruptcy, care costs and unnecessary tax. Planning ahead lets you address each risk before it arises rather than reacting afterwards. The right approach depends on your family, assets and goals. For some clients it is a simple change of Will; for others it involves trusts, business agreements and a coordinated plan across several generations.

Joint ownership and the family home

Most couples own their home as joint tenants, meaning it passes automatically to the survivor regardless of any Will. Severing the joint tenancy to become tenants in common allows each person to leave their share through their Will, often into a protective trust. This simple step helps ensure your children's inheritance is protected if the surviving partner remarries, needs care or changes their own Will. A notice of severance is registered with HM Land Registry, and a declaration of trust can record unequal shares if you contributed differently. We explain the consequences fully before any change in ownership is made.

Staying within the law

Genuine asset protection must be transparent and properly timed. Transfers made mainly to avoid creditors or care fees can be challenged under the Insolvency Act 1986 or the deliberate deprivation rules used by local authorities. Telmar focuses on legitimate, well-documented planning carried out for sound family reasons, so your arrangements stand up to scrutiny and deliver the protection you intend. We keep clear records of the reasons for each decision. This audit trail helps demonstrate that your planning was carried out properly and in good faith, protecting both you and your beneficiaries in the future.
