How Trusts Protect Your Family's Wealth

What a trust is

A trust is a legal arrangement where a settlor transfers assets to trustees, who manage them for the benefit of named beneficiaries. Trusts can be created during your lifetime or through your Will. Common types include bare trusts, interest in possession trusts, discretionary trusts and vulnerable person trusts. Each has different rules for control, income tax, capital gains tax and inheritance tax, so the right choice depends on your objectives. Trustees have legal duties to act in the beneficiaries' best interests, keep accurate records and invest prudently. A letter of wishes, while not binding, guides trustees on how you would like the trust to be managed.

Why families use trusts

Trusts can protect inheritances from a beneficiary's divorce, bankruptcy or poor financial decisions, provide for children until they are mature enough to inherit outright, and support vulnerable beneficiaries without affecting means-tested benefits. In second marriages, a protective property trust can let a surviving spouse stay in the home while preserving the children's share. Trusts can also form part of a wider inheritance tax strategy. A trust can also provide privacy, because unlike a Will that becomes public after probate, trust arrangements are not usually open to public inspection. This can be important for families with sensitive or complex circumstances.

Trust tax and HMRC registration

Most lifetime discretionary trusts fall within the relevant property regime, with a 20% entry charge on transfers above the available nil-rate band, ten-yearly charges of up to 6% and exit charges. Most UK express trusts must also be registered on HMRC's Trust Registration Service. Telmar explains these rules clearly, recommends suitable trustees and keeps your trust structure compliant and reviewed. Trustees may also need to file annual self-assessment returns and pay income tax at trust rates. Getting the structure right at the outset avoids unnecessary charges and keeps administration manageable for your chosen trustees.
