What probate involves
Probate is the legal process of dealing with someone's estate after they die. Executors named in the Will, or administrators if there is no Will, apply for a Grant of Representation, value the estate, report it to HMRC, pay any inheritance tax and debts, and distribute what remains. Probate is usually needed where assets exceed around £5,000 or include property held in a sole name. Executors are personally responsible for getting this right, including paying debts in the correct order and completing HMRC forms accurately. Mistakes can leave executors personally liable, so many families welcome clear guidance and support.
